Terms & Conditions

Participation in the prize draw and its execution are subject to the following terms and conditions:

§ 1 Giveaway

The giveaway “Win a MINOX X-PRO 10x42 at the Helgoland Bird Days 2026” (hereinafter referred to as the “Giveaway”) will take place from October 22 to October 25, 2026. The prize consists of a MINOX X-PRO 10x42, organized and conducted by Blaser Group GmbH, Ziegelstadel 1, 88316 Isny im Allgäu, Germany (hereinafter referred to as the “Organizer”). The Organizer alone is the promoter within the meaning of Section 657 of the German Civil Code (BGB).

§ 2 Participation

(1) Only natural persons who have reached the age of 18 and are residents of one of the following countries are eligible to participate in the prize draw (“Participants”): Germany, Austria or Switzerland.

(2) Only natural persons are eligible to participate.

(3) Participation in this Giveaway is free of charge. Participation is not restricted to customers of the Organizer and is not conditional upon the purchase of any goods or services.

Participation in the Giveaway is exclusively via the Organizer’s Instagram channel.

(4) Participants must follow the participation requirements described in the giveaway. Only Participants who have fulfilled all participation requirements described in the giveaway will be considered for the prize draw. Otherwise, participation in the prize draw is excluded.

(5) All information provided by Participants must be truthful. Otherwise, the Participant will be excluded from the Giveaway and from the prize draw in accordance with § 3 (2) (d) of these Terms and Conditions. Winners will be contacted exclusively via direct message on Instagram.

(6) We expressly point out that no further confirmation of a winner by calling premium-rate, mass-call, shared-cost or other value-added telephone numbers is required. Such requests do not originate from the Organizer. If a Participant receives a request via any means of communication to call a telephone number to confirm the prize, we strongly recommend ignoring such a request, as we are aware that such requests may serve fraudulent purposes.

(7) Participation is valid only during the period from October 22, 2026 to October 24, 2026. The prize draw for the MINOX X-PRO 10x42 will take place after the event on Helgoland.

§ 3 Exclusion from the Giveaway

(1) Employees of the Organizer, as well as all other persons involved in the conception and implementation of the Giveaway and the prize draw, and their family members, are excluded from participation in the Giveaway and the prize draw.

(2) The Organizer also reserves the right, at its own discretion, to exclude Participants from the Giveaway and the prize draw if there are legitimate reasons for doing so.

Legitimate reasons include, in particular:

(a) manipulation in connection with access to or the implementation of the Giveaway or prize draw,

(b) violations of these Terms and Conditions, in particular in the event of false information regarding eligibility to participate in the prize draw,

(c) unfair conduct, or

(d) false or misleading information concerning the Participant’s identity in connection with participation in the Giveaway and the prize draw.

(3) The Organizer reserves the right to exclude Participants from the Giveaway and the prize draw insofar as this is necessary for reasons of fairness and equal opportunities for all Participants.

(4) The Organizer reserves the right to exclude Participants from the Giveaway in the event of any multiple registration.

§ 4 Conduct and Processing of the Giveaway

(1) After the end of the Giveaway period, the winner will be determined by random draw among all eligible Participants.

(2) All Participants who take part during the Giveaway period and meet the requirements set out in § 2 (2) will participate in the prize draw.

(3) Participation in the Giveaway is valid only during the period from August 8, 2025 to August 27, 2025.

(4) The entitlement to the prize arises exclusively upon receipt of the prize notification.

(5) The prizes will not be paid out in cash. This also applies if the prize is no longer available in the version originally presented (e.g. due to a model change, seasonal products, etc.). Vouchers will likewise not be paid out in cash.

(6) The claim to the prize or any substitute prize may not be assigned to another person.

(7) The winner is responsible for any taxes that may arise in connection with the prize.

§ 5 Warranty and Liability / Complaints

(1) The winner must report any obvious defects in the prize to the Organizer within 10 days of receiving the prize. To meet the deadline, it is sufficient for the complaint to be sent in good time. If the deadline is missed, warranty claims relating to obvious defects shall no longer apply.

(2) The Organizer shall not be liable for any damage resulting from errors, delays or interruptions in transmission, malfunctions of technical equipment or services, incorrect content, loss or deletion of data, viruses or otherwise in connection with participation in the Giveaway or the prize draw, unless such damage was caused intentionally or through gross negligence by the Organizer, its representatives, employees or agents, or through a breach of essential contractual obligations. This shall not affect liability for damages resulting from injury to life, body or health.

(3) Complaints relating to the implementation of the Giveaway must be submitted to the Organizer in writing within 14 days of becoming aware of the grounds for the complaint. Complaints submitted by telephone or after the deadline will not be considered.

(4) Exchange of the prize received is excluded.

§ 6 Early Termination of the Giveaway

The Organizer expressly reserves the right to terminate the prize draw without prior notice and without stating reasons. The Organizer may exercise this right in particular if the proper implementation of the Giveaway and the prize draw cannot be guaranteed for technical or legal reasons. If such termination is caused by the conduct of a Participant, the Organizer reserves the right to claim damages from that Participant.

§ 7 Data Protection

(1) All personal data of the Participant will be processed and used by the Organizer in accordance with applicable legal provisions.

(2) The Organizer collects, processes, uses and stores the data provided by the Participant during registration exclusively for the duration of the Giveaway and the prize draw for the purpose of conducting and processing the Giveaway and, where applicable, passes such data on to transport companies commissioned for this purpose. Without the express consent of the Participant, registration data will not be used or stored for any other purposes by the Organizer or third parties.

(3) The Participant expressly agrees to the publication of submitted photographs, in particular portrait/profile photos and group photos in connection with the Participant’s name, on internet platforms and/or social media channels (e.g. Instagram, Facebook, newsletter) that the Participant has submitted to the Organizer in connection with the Giveaway. The images may be edited and modified while respecting the Participant’s personal rights. However, there is no express entitlement to the publication of submitted materials on the Organizer’s social media channels in connection with the Giveaway.

§ 8 Revocation

The Participant may revoke their participation in the Giveaway at any time. Revocation must be submitted in writing to the Organizer using the contact details provided in the legal notice (Imprint) section of www.minox.com. Following revocation of participation in the Giveaway, the personal data collected and stored will be deleted without undue delay. The Participant thereby withdraws from participation in the Giveaway and the prize draw.

§ 9 Disclaimer

(1) This promotion is not affiliated with Facebook and is in no way sponsored, supported or organized by Facebook. No legal claims therefore exist against Facebook. Participation via Facebook is subject exclusively to these Terms and Conditions.

(2) This promotion is not affiliated with Instagram and is in no way sponsored, supported or organized by Instagram. No legal claims therefore exist against Instagram. Participation via Instagram is subject exclusively to these Terms and Conditions.

§ 11 Miscellaneous

(1) Questions or complaints relating to the Giveaway and the prize draw should be addressed to the Organizer. Contact details can be found in the legal notice (Imprint) section of www.MINOX.com.

(2) Legal recourse is excluded.

(3) The laws of the Federal Republic of Germany shall apply exclusively.

(4) Should any provision of these Terms and Conditions be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions. In place of the invalid provision, the legally permissible provision that most closely reflects the economic purpose and intent of the invalid provision shall apply. The same shall apply in the event of a regulatory gap.

(5) The Organizer may amend the participation and implementation conditions at any time without prior notice and without stating reasons. Amendments and supplementary agreements concerning the conditions for prize processing must be made in writing to be effective.
